Terms of Service

1. The MoveTube Service

MoveTube provides technology that allows consumers to discover, search, view, save, and interact with real estate information through websites, television applications, and other digital services.

Certain property-search features may be provided through technology, services, and real estate listing data licensed from or made available through Realty.com, LLC (“Realty.com”), its affiliates, multiple listing services (“MLSs”), brokers, and other third-party data providers.

Property searches initiated through MoveTube may be displayed through a Realty.com-hosted or Realty.com-licensed search environment, including MoveTube.Realty.com, or another Realty.com domain, subdomain, application, or technology platform.

These Terms apply to MoveTube’s consumer-facing Service. Separate products or services offered to real estate agents, lenders, advertisers, or other business users, including MoveTube Studio and related business platforms, may be governed by separate agreements or terms.

2. Property Listings and MLS Data

Real estate listing information displayed through the Service may be provided to MoveTube under license through Realty.com and may originate from participating MLSs, real estate brokers, listing agents, and other real estate data providers.

MoveTube does not independently create or verify MLS listing information.

Listing information may include, among other things, property addresses, prices, listing status, photographs, property characteristics, descriptions, days on market, broker and agent information, school information, neighborhood information, maps, and other real estate-related information.

Although listing information is obtained from sources believed to be reliable, listing information is not guaranteed to be accurate, complete, current, or error-free and should be independently verified before being relied upon in connection with any real estate decision or transaction.

Property availability, price, listing status, property characteristics, square footage, taxes, school assignments, boundaries, measurements, and other information may change without notice.

MoveTube does not guarantee that any property displayed through the Service remains available for sale, lease, or other transaction.

3. MLS, Brokerage, and Data-Provider Disclosures

Real estate listing information may be subject to rules and requirements established by the MLS, brokerage, listing agent, Realty.com, or other data provider responsible for the applicable listing.

Required MLS attribution, copyright notices, broker identification, disclaimers, data-source information, and other disclosures may therefore vary based upon the property, geographic market, and source of the listing information.

Such disclosures may appear on search-result pages, property-detail pages, maps, application screens, or elsewhere within the Service and are incorporated into these Terms where applicable.

You agree not to remove, obscure, alter, or circumvent any MLS, brokerage, copyright, attribution, or data-provider notice displayed through the Service.

4. Realty.com Property Search Services

MoveTube licenses certain property-search technology and real estate data services from Realty.com.

Depending upon the applicable property-search service, you may be redirected to or interact with a Realty.com-hosted experience, including a MoveTube-branded Realty.com subdomain.

Certain MLS data or features may require account registration, authentication, or other credentials before access is permitted.

MoveTube and Realty.com are independent parties. Nothing in these Terms authorizes MoveTube to act as an employee, representative, or agent of Realty.com.

Realty.com, applicable MLSs, brokers, and other data providers retain their respective rights in their software, systems, listing information, photographs, databases, trademarks, and other proprietary materials.

5. No Brokerage or Professional Relationship Created

Use of the Service does not, by itself, create a real estate brokerage relationship, agency relationship, fiduciary relationship, lender-borrower relationship, attorney-client relationship, or other professional relationship between you and MoveTube.

MoveTube provides technology and real estate information.

Any brokerage, mortgage, title, insurance, appraisal, legal, or other professional services made available or promoted through the Service are provided by the applicable licensed professional or company identified in connection with those services.

MoveTube does not provide legal, tax, appraisal, mortgage, investment, or other professional advice through the consumer property-search Service.

You should consult the appropriate licensed professional before making decisions relating to the purchase, sale, lease, financing, or valuation of real estate.

6. Accounts

Certain features of the Service may require you to create an account.

When creating an account, you agree to provide information that is accurate, complete, and current.

You are responsible for safeguarding your password, login credentials, and account information and for activity occurring through your account.

You must notify us promptly if you believe your account or credentials have been accessed or used without authorization.

You may not impersonate another person, create an account using false information, or use another person’s account without authorization.

We may suspend or terminate an account that violates these Terms or is used in connection with fraudulent, abusive, illegal, or unauthorized activity.

7. Communications

By providing contact information to MoveTube, you agree that we may send communications reasonably necessary to provide the Service, including account notices, saved-search notifications, security messages, requested property information, and other service-related communications.

Marketing or promotional communications will be sent only as permitted by applicable law and, where required, with appropriate consent.

You may unsubscribe from promotional email communications using the unsubscribe instructions contained in those messages.

Certain service-related communications may be necessary to operate your account and may continue while your account remains active.

Additional consent disclosures may be presented when you specifically request telephone calls, SMS messages, property alerts, agent contact, or other communications.

8. Permitted Use of Property Information

Property information available through the Service is provided for legitimate real estate-search and consumer-information purposes.

Unless otherwise expressly authorized, you may not systematically copy, scrape, harvest, download, extract, reproduce, redistribute, publish, sell, sublicense, or commercially exploit MLS data or other listing information obtained through the Service.

You may not use automated systems, bots, crawlers, spiders, scraping technologies, artificial-intelligence training systems, or similar technologies to obtain listing information from the Service without our prior written authorization.

You may not use the Service to create, populate, enhance, or maintain a competing real estate database, listing service, valuation product, analytics product, or commercial data product.

Nothing in these Terms grants you ownership rights in MLS data or other third-party listing information.

9. Prohibited Conduct

You may not use the Service in a manner that:

(a) violates applicable law or regulation;

(b) infringes intellectual property, privacy, publicity, contractual, or other rights;

(c) interferes with or disrupts the Service or its infrastructure;

(d) attempts to gain unauthorized access to systems, accounts, networks, databases, or information;

(e) circumvents access controls, registration requirements, security protections, or technological restrictions;

(f) introduces malware, malicious code, or other harmful technology;

(g) misrepresents your identity or affiliation;

(h) uses the Service to conduct fraudulent or deceptive activity; or

(i) violates applicable MLS, broker, Realty.com, or data-provider restrictions.

We may take reasonable technical measures to prevent unauthorized scraping, copying, access, or use of listing information.

10. User-Provided Content

If the Service permits you to submit reviews, comments, photographs, messages, profile information, or other content (“User Content”), you remain responsible for that User Content.

You represent that you have the necessary rights and permissions to submit the User Content and that your submission does not violate the rights of any other person or entity.

By submitting User Content to the Service, you grant MoveTube a nonexclusive, worldwide, royalty-free license to host, store, reproduce, display, transmit, and use that content as reasonably necessary to operate, provide, promote, and improve the Service.

This license does not transfer ownership of your User Content to MoveTube.

We may remove User Content that violates these Terms or applicable law.

11. MoveTube Intellectual Property

Except for MLS data, listing photographs, third-party content, User Content, and other material owned by others, the MoveTube Service, including its software, design, branding, logos, interfaces, original content, and functionality, is owned by or licensed to Realty Stars, Inc.

The MoveTube name, trademarks, logos, trade dress, and related branding may not be used without prior written authorization.

Realty.com, MLSs, brokers, agents, and other third parties retain ownership of their respective trademarks, copyrights, databases, photographs, listing information, and other intellectual property.

No rights are granted except those expressly provided in these Terms.

12. Copyright and DMCA Policy

MoveTube respects the intellectual property rights of others.

If you believe that material appearing through the Service infringes your copyright, you may send a written notice to: dmca@movetube.com

Your notice should include the information required by the Digital Millennium Copyright Act, including:

1. identification of the copyrighted work claimed to have been infringed;
2. identification of the material claimed to be infringing and sufficient information for us to locate it;
3. your name, address, telephone number, and email address;
4. a statement that you have a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law;
5. a statement, under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on the owner’s behalf; and
6. your physical or electronic signature.

We may remove or disable access to material that is the subject of a valid DMCA notice and, where appropriate, terminate repeat infringers.

13. Privacy

Our collection, use, and sharing of personal information in connection with the Service is described in our Privacy Policy, which is incorporated into these Terms by reference.

If you do not agree with our Privacy Policy, you should not use the Service.

14. Third-Party Services and Links

The Service may contain links to, or integrate with, third-party websites, applications, television platforms, payment processors, mapping providers, advertising networks, or other services.

MoveTube is not responsible for the content, terms, privacy practices, or availability of third-party services. Your use of those services is at your own risk and may be subject to additional terms.

15. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, MOVETUBE DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, secure, or free of errors, or that listing information, maps, or other content will be accurate or complete.

16. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MOVETUBE AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF ONE HUNDRED U.S. DOLLARS ($100) OR THE AMOUNT YOU PAID TO MOVETUBE FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE CLAIM.

Some jurisdictions do not allow certain limitations. In those jurisdictions, our liability is limited to the fullest extent permitted by law.

17. Indemnification

You agree to indemnify and hold harmless Realty Stars, Inc., its affiliates, and their officers, directors, employees, and agents from claims, losses, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising out of your use of the Service, your User Content, or your violation of these Terms or applicable law.

18. Termination

We may suspend or terminate your access to the Service at any time if we reasonably believe you have violated these Terms, created risk or possible legal exposure for MoveTube, or if we discontinue the Service.

You may stop using the Service at any time. Provisions that by their nature should survive termination will survive, including ownership, disclaimers, limitations of liability, and governing law.

19. Governing Law and Disputes

These Terms are governed by the laws of the United States and the State in which Realty Stars, Inc. maintains its principal place of business, without regard to conflict-of-law principles.

Except where prohibited by law, exclusive venue for any dispute arising out of these Terms or the Service will be the state and federal courts located in that principal place of business, and you consent to personal jurisdiction there.

This section is intended as a working draft and should be confirmed by legal counsel before being treated as final.

20. Changes to These Terms

We may update these Terms from time to time. The “Last Updated” date at the top of this page will be revised when we do.

Your continued use of the Service after updated Terms are posted constitutes acceptance of the revised Terms, except where applicable law requires additional notice or consent.
