Information We Collect

We may collect information that you provide directly to us, information generated through your use of the Services, and information provided to us by service providers and business partners.

Information You Provide

Depending on the features you use, we may collect information such as:

• first and last name;
• email address;
• telephone number;
• mailing address;
• account login information;
• real estate preferences;
• saved properties and searches;
• property inquiries;
• showing or contact requests;
• communications you send through the Services;
• information you provide when contacting customer support; and
• other information you voluntarily provide.

You are not required to provide personal information merely to browse all portions of the Services. Certain features, however, may require registration or additional information.

Property Search and Usage Information

When you use MoveTube, we may collect information regarding your interaction with the Services, including:

• properties you search for, view, save, or share;
• cities, ZIP codes, neighborhoods, price ranges, and other search criteria;
• search history;
• favorites and saved searches;
• inquiries and requests for additional information;
• interactions with real estate professionals or lenders;
• pages and screens viewed;
• links or features selected; and
• dates, times, and duration of activity.

This information allows us to provide property-search functionality, personalize the Services, maintain saved searches and favorites, improve our products, and understand how consumers use MoveTube.

Device and Technical Information

We may automatically collect information such as:

• Internet Protocol (IP) address;
• browser type;
• operating system;
• device type;
• television or streaming platform;
• application version;
• device or advertising identifiers, where available;
• referring and destination pages;
• approximate location derived from IP address;
• error logs and diagnostic information; and
• other technical information relating to your interaction with the Services.

If a feature requests access to precise device location, we will use the permission mechanisms provided by your device or operating system.

Cookies and Similar Technologies

MoveTube and its service providers may use cookies, software development kits (“SDKs”), pixels, local storage, device identifiers, and similar technologies to operate the Services, remember preferences, analyze usage, maintain security, measure performance, and, where applicable, support advertising or marketing.

You may be able to control certain technologies through your browser, device, operating-system settings, or the privacy controls we make available.

Disabling certain technologies may cause some features of the Services not to function properly.

Realty.com and Property Listing Services

MoveTube licenses property-search technology and nationwide real estate listing-data services from Realty.com.

Property searches initiated through MoveTube may be delivered through a Realty.com-hosted or Realty.com-licensed search experience, including MoveTube.Realty.com.

In connection with providing these services, Realty.com and its technology infrastructure may process information necessary to provide property search, listing displays, account registration, saved searches, analytics, system security, and related functionality.

Property listing information displayed through the Services may originate from multiple listing services (“MLSs”), brokers, Realty.com, and other authorized real estate data sources.

Real estate listing information is separate from the personal information MoveTube collects about you as a user of the Services.

Where Realty.com independently collects or processes information under its own services, additional Realty.com privacy notices may apply.

How We Use Information

We may use personal information for purposes including:

• providing and operating the Services;
• providing property searches and listing information;
• creating and maintaining your account;
• remembering saved properties, searches, and preferences;
• responding to inquiries and support requests;
• connecting you with real estate professionals or other professionals when appropriate;
• providing requested property information;
• sending account, service, and security notifications;
• providing marketing communications where permitted;
• improving the performance and usability of MoveTube;
• analyzing consumer activity and product usage;
• detecting fraud, abuse, scraping, security threats, or unauthorized activity;
• complying with MLS and data-provider requirements;
• enforcing our Terms of Service;
• complying with legal obligations; and
• protecting MoveTube, our users, our partners, and others.

We may also create aggregated or deidentified information that does not reasonably identify an individual and use that information for analytics, product development, reporting, and other lawful purposes.

Real Estate and Lending Professionals

MoveTube may work with participating real estate agents, brokers, mortgage professionals, and other real estate-related professionals.

If your account, search experience, or inquiry is associated with a participating professional, or if you request information, request a showing, ask to be contacted, or otherwise interact with a professional through MoveTube, we may provide that professional with information relevant to the interaction.

Depending on the service and your relationship with that professional, this may include:

• your name;
• contact information;
• property inquiries;
• saved or viewed properties;
• search activity;
• appointment or showing requests; and
• information you specifically provide in connection with the inquiry.

A participating professional may contact you regarding your inquiry, properties in which you have expressed interest, or services you have requested.

Any legally required consent for marketing telephone calls, text messages, prerecorded or artificial-voice communications, or similar communications will be obtained separately when required. Providing consent to receive marketing communications is not automatically created merely by reading or accepting this Privacy Policy.

Once personal information is provided to an independent real estate professional, lender, or other third party acting for its own purposes, that party may have its own privacy practices and legal obligations.

How We Disclose Information

We may disclose information to the following categories of recipients.

Service Providers

We may use companies that provide services such as:

• hosting and cloud infrastructure;
• property-search technology;
• MLS and real estate data services;
• analytics;
• customer support;
• communications;
• email and text-message delivery;
• cybersecurity;
• application development;
• database management; and
• other technology or operational services.

These providers may process personal information as necessary to provide services to MoveTube.

Participating Professionals

We may disclose information to participating real estate or lending professionals as described above when the information is relevant to the user’s MoveTube experience, inquiry, registration, or requested services.

Business Transactions

If MoveTube or Realty Stars, Inc. is involved in a merger, acquisition, financing, restructuring, sale of assets, or similar transaction, personal information may be disclosed as part of evaluating or completing that transaction, subject to applicable law.

Legal and Safety Purposes

We may disclose personal information when we reasonably believe disclosure is necessary to:

• comply with applicable law, regulation, subpoena, court order, or legal process;
• respond to lawful requests from governmental authorities;
• investigate suspected fraud or illegal activity;
• enforce our agreements;
• protect the security or integrity of the Services; or
• protect the rights, property, or safety of MoveTube, our users, or others.

Sale and Sharing of Personal Information

MoveTube does not operate as a data broker and does not sell personal information for monetary consideration as part of its ordinary business model.

However, certain U.S. state privacy laws, including California law, define terms such as “sale,” “sharing,” and “targeted advertising” more broadly than their ordinary meanings.

Certain disclosures involving advertising technologies, analytics providers, participating professionals, lead-generation activities, or other partners may be treated as a sale, sharing, or targeted advertising under applicable law even where MoveTube does not receive monetary payment for the personal information.

Where applicable law provides a right to opt out of these activities, MoveTube provides consumers with a method to exercise that right through our Your Privacy Choices page.

Where required by applicable law, MoveTube will also honor recognized browser-based opt-out preference signals, including Global Privacy Control (GPC).

Email, Telephone, and Text Communications

MoveTube may send service-related communications concerning your account, saved searches, inquiries, security, or use of the Services.

Where permitted, we may also send marketing or promotional communications.

You may unsubscribe from marketing email by using the unsubscribe link contained in the message.

Where text-message services are offered, applicable opt-out instructions will be included with those services.

You may continue to receive non-marketing communications that are necessary to operate your account or respond to requests you have made.

Communications, Calls, and AI-Assisted Services

If you communicate with MoveTube or through a MoveTube communication feature, we may collect the content and metadata associated with the communication.

Calls may be recorded or transcribed for customer service, quality assurance, security, training, or service-delivery purposes where permitted by law and after any notice or consent required by applicable law.

MoveTube may use automated or artificial-intelligence-assisted technologies to help provide customer service, property information, communications, or other features.

Where automated technology is used in a manner requiring additional disclosure, consent, or consumer rights under applicable law, we will provide those disclosures or controls.

Data Retention

We retain personal information for only as long as reasonably necessary for the purposes for which it was collected, including to:

• provide the Services;
• maintain an account;
• satisfy contractual or MLS-related requirements;
• maintain business and transaction records;
• resolve disputes;
• prevent fraud and abuse;
• enforce agreements; and
• satisfy legal, regulatory, tax, accounting, or security obligations.

Retention periods may vary depending upon the type of information and the reason it was collected.

We may retain aggregated or deidentified information where permitted by law.

Security

MoveTube uses commercially reasonable administrative, technical, and organizational safeguards designed to protect personal information against unauthorized access, disclosure, alteration, loss, or misuse.

No method of electronic transmission or storage can be guaranteed to be completely secure, and therefore we cannot guarantee absolute security.

Your Privacy Rights

Depending upon where you reside and applicable law, you may have the right to:

• request confirmation that we process personal information about you;
• access personal information we maintain about you;
• obtain a copy of certain personal information;
• correct inaccurate personal information;
• request deletion of personal information;
• opt out of certain sales or sharing of personal information;
• opt out of certain targeted advertising;
• limit certain uses or disclosures of sensitive personal information;
• withdraw consent where processing is based upon consent; and
• appeal certain decisions regarding a privacy request.

We will not unlawfully discriminate against you for exercising a privacy right.

We may need to verify your identity before completing certain requests. Where permitted by law, an authorized agent may submit a request on your behalf.

If applicable law provides a right to appeal our decision regarding a privacy request, you may submit an appeal by contacting us at the address above and including “Privacy Appeal” in the subject line.

California Privacy Rights

California residents may have additional privacy rights under the California Consumer Privacy Act, as amended (“CCPA”), including rights to access, know, delete, correct, and obtain information concerning certain disclosures of personal information, as well as rights to opt out of certain sales or sharing of personal information and certain uses of sensitive personal information.

MoveTube will not unlawfully discriminate against a consumer for exercising applicable privacy rights.

Other U.S. State Privacy Rights

Residents of certain other states may also have privacy rights under state law.

Where applicable, MoveTube will honor rights such as access, correction, deletion, portability, opting out of targeted advertising or certain data disclosures, and appeal rights in accordance with applicable law.

Because state privacy laws and their applicability vary, the rights available to you may depend upon your place of residence and the nature of MoveTube’s processing activities.

Children

The Services are not directed to children under 13 years of age.

MoveTube does not knowingly collect personal information from children under 13.

If we learn that personal information has been collected from a child under 13 without legally valid parental authorization, we will take appropriate steps to delete it.

We do not knowingly sell or share the personal information of children in violation of applicable law.

Third-Party Websites and Services

The Services may contain links to or integrations with websites, applications, professionals, advertisers, or services that are not operated by MoveTube.

We are not responsible for the privacy practices of independent third parties.

We encourage you to review the privacy policies provided by third parties before providing them with personal information.

Users Outside the United States

MoveTube’s consumer real estate services are primarily intended for the United States.

If you access the Services from another country, your information may be processed and stored in the United States or other countries where MoveTube’s service providers operate.

Different countries may provide different levels of data protection.

Where applicable law requires additional protections for international transfers or processing, MoveTube will implement the required safeguards.

Changes to This Privacy Policy

We may update this Privacy Policy from time to time to reflect changes to our Services, business practices, technology, legal requirements, or relationships with service providers.

When we make material changes, we may provide notice through the Services, by email, or by other appropriate means.

The Effective Date at the top of this Privacy Policy identifies when the current version became effective.
